1. Acceptance of Terms

By accessing or using GymCharge ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the App.

2. Description of Service

GymCharge is a fitness accountability application that:

• Allows users to set workout schedules
• Verifies gym attendance through location-based check-ins
• Automatically charges penalty fees for missed workouts
• Provides grace skips for legitimate absences

3. Eligibility

You must be at least 18 years old to use GymCharge. By using the App, you represent and warrant that you meet this requirement.

4. Account Responsibilities

You agree to:

• Provide accurate and current information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use
• Be responsible for all activities under your account

5. Payment and Penalties

5.1 Penalty Fees

• You set your own penalty fee (minimum $1.00) when configuring your account
• Penalty fees can only be changed once every 7 days to prevent manipulation
• If you miss a scheduled workout without using a grace skip, you will be automatically charged your penalty fee
• All charges are final and non-refundable

5.2 Grace Skips

• You receive 3 grace skips per calendar month
• Grace skips reset on the first day of each month
• Unused grace skips do not roll over to the next month
• Grace skips must be used before a scheduled workout to avoid charges

5.3 Payment Processing

All payments are processed securely through Stripe. By using the App, you agree to Stripe's terms and conditions. We do not store your full payment card information.

6. Workout Schedules

• You can set your workout schedule by day of the week
• Once saved, your schedule is locked for 30 days to ensure commitment
• You can mark individual dates as exceptions (skip or add that day only)
• Schedule changes can only be made after the 30-day lock

7. Location Verification

• Check-ins require location services to be enabled
• You must be within your set check-in radius of your gym
• One check-in per scheduled day is sufficient to avoid penalties
• Location data is only collected during active check-ins
• Attempting to spoof or manipulate location data is prohibited and may result in account termination

8. Prohibited Conduct

You may not:

• Use the App for any illegal purpose or in violation of any laws
• Attempt to circumvent check-in verification or manipulate the system
• Share your account credentials with others
• Reverse engineer, decompile, or disassemble the App
• Use the App in any way that could harm or disable it

9. Account Termination

9.1 By You

You may cancel your account at any time through the App settings. Upon cancellation, all your data will be permanently deleted, including check-in history, payment information, and schedules.

9.2 By Us

We reserve the right to suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent or illegal activity
• Attempt to manipulate the check-in system

10. Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. GYMCHARGE:

• Does not guarantee uninterrupted or error-free service
• Is not responsible for your fitness results or health
• Does not provide medical, health, or fitness advice
• Is not liable for location service errors or inaccuracies

Always consult with a healthcare professional before starting any fitness program.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GYMCHARGE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or in-app notification. Your continued use of the App after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
